ASC Data Breach Involving Social Security Numbers 8

ASC Data Breach Involving Social Security Numbers

On October 13, 2022, the Appraisal Subcommittee discovered a data breach that occurred on the new ASC.gov website. The incident involved Social Security Numbers. They made an announcement on January 24, 2023 and have contacted all State Appraiser Regulatory Agencies concerning the data breach. They are also notifying all individuals whose Personal Identifiable Information had potential for exposure. Those appraisers who could have had their data exposed will be offered credit monitoring to prevent identity theft. The Appraisal Subcommittee (ASC) is contacting all State Appraiser Regulatory Agencies concerning a data breach that occurred on the ASC.gov website. Please note: This...

Spear Throwers Using Census Data as Evidence for Bias 31

Census Data Used as Evidence for Bias

I’ve previously written about how the various spear throwers at appraisers have used ‘census tract data’ in their assertions that appraisers are racially biased. It’s been done by Freddie Mac, by Andre Perry in his testimony before Congress, by Ph.D Elizabeth Korver-Glenn in her dissertation paper, not reviewed by anyone with appraisal experience, to obtain that lofty status, the media, and other so called ‘studies’ and ‘reports’ since. That is information foreign to appraisers, because we don’t use or reference anything about Census Tracts in our reports. The only place that shows up is in one field on the GSE...

Your Trade Has Been Under Assault for Years 5

Your Trade Has Been Under Assault for Years!

Your trade has been under assault for years. The de minimus rule was the first I sensed of the end of your trade. I am going off of vague memory but I think it was 1997, and at the time, the near majority of my town was below the $250,000 threshold, as were 90% of the towns adjacent. I remember an old horse telling me the handwriting was on the wall for him and his kind. As I reflect on it there have been repeated efforts to pare down the costs of borrowing by trimming fees for title and other...

"Valuable" Advice From an AMC - Valuation Connect 57

“Valuable” Advice From an AMC

The person who espouses this super valuable ‘advice’ does not have an appraiser’s license… Appraisers, if you think I’m serious about the message subject line, please reconsider! It’s time to actually call out an AMC who’s encouraging appraisers to ‘lower their fee’: Valuation Connect This outfit sent out a ‘newsletter’ to appraisers, part of which says this: “My advice would be to make adjustments based on the market. Some examples in a slow market would be adding a new county or zip code to your coverage area, lowering your fee for a product, or adding a new product to your...

Tenant in Distress... What Would You Do? 11

Tenant in Distress… What Would You Do?

These situations apparently caused a severe depression to engulf the tenant.  Appraisers, last week I received a call from an appraiser who was very upset about an encounter at the Subject dwelling, within city limits, not long before, and wanted to know ‘what to do.’ The appraiser scheduled an inspection for a dwelling being sold, and uses a ‘MLS Key’ for entry to homes with a lockbox, without having an agent present. The appraiser had previously been told by the listing agent that the tenant of the dwelling might be present, in a state of distress, because that person had...

FastApp AMC Alleged Violations of Appraiser Independence Requirements 52

Fastapp AMC Alleged Violations of AIR

The following court documents in the case Naftali Horowitz v. [xxx], Fastapp AMC founder v. Fastapp AMC president, confirm what appraisers have been saying all along, that if you want high-volume AMC work, you have to lower your fees to 1980’s level, have 24 hour turn times, and, above all, be a number hitter. Horowitz, Fastapp founder, filed a lawsuit in New York court on January 31, 2022 against defendant to, among other things, remove the defendant as an officer and director of the Company because, when he brought her on as shareholder in 2020, he claimed that she made...

Fannie Seeks Upstanding Invisibles for Long-Term Commitment 11

Fannie Seeks Upstanding Invisibles for Long-Term Commitment

Fannie’s big news about embracing the “invisibles,” under the pretext of helping the underserved, Fannie announced it had tweaked the knobs and dials on its impenetrable underwriting algorithm in order to fit “credit invisibles” for mortgages.  In the final scene of the 1990 mob masterpiece “Goodfellas,” wise guy Henry Hill recalls his life as he enters federal witness protection. “It was easy to disappear. My house was in my mother-in-law’s name. My cars were registered to my wife. My Social Security card and driver’s license were phony. I never voted. I never paid taxes. My birth certificate and my arrest...

Appraiser Countersuing Black Homeowners for Defamation 165

Appraiser Countersuing Black Homeowners for Defamation

The Maryland appraiser has filed a countersuit against the homeowners, claiming defamation.  Appraisers, there have been several lawsuits filed against appraisers by borrowers who “don’t like your value, so I’m accusing you of discrimination” over the last year or so. These lawsuits all have the same theme, and it’s entirely possible that these actions are being coordinated by a consortium of ‘organizers’ and law firms. The plaintiff representing firm for the Baltimore suit is the same law firm The Appraisal Foundation hired to write new USPAP language for the Ethics Rule, which potentially will be approved in just a few...

Vote With Your Wallet. We Can’t Boycott the AMC Industry Twice 18

Vote With Your Wallet. We Can’t Boycott the AMC Industry Twice

Vote with your wallet. Vote with your feet. Vote with your time. Vote with your patronage. Vote with your clicks. Sorry to inform those who are seeking someone else to bail them out of this continued blatant abuse of power and ongoing racketeering enterprise known as Appraisal Management Companies (AMCs). We can’t boycott the AMC industry twice. It’s your turn now. And that’s the rub, it’s our industry, not some other groups industry. Without appraisers, there is no valuation services industry. The appraisal management groups presence is irrelevant unless appraisers choose to make the AMCs relevant with patronage. Each appraisers...

House Measurement by Property Data Collector Gone Wrong 142

House Measurement by Property Data Collector Gone Wrong

The lender allowed an unlicensed property data collector give bad data to the appraiser… I work for this lender and they will not let my trainee inspect. The owners are now underwater by more than $100,000…  I’m sad and I’m mad! I recently took on a measure job for a client who was questioning the square footage of their home. The couple bought the house at the height of the market last year. They paid 12% over list price to get the house. They put an appraisal waiver in the contract which meant they could not walk away if the...
